Abstract

This article aims to analyze how legal pluralism operates in marriage practices in Indonesia and its implications for the protection of family rights, particularly for women and children. Normatively, the author argues that legal pluralism is not simply a neutral social reality but must be managed within a constitutional framework that guarantees legal certainty and protection. This research uses a normative legal research method with a legal sociology approach based on literature studies. Data were obtained from laws and regulations, particularly Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law, as well as relevant scientific literature. The results of the study indicate that in social practice, religious and customary legitimacy are often prioritized over state registration, which is seen as an administrative formality. This condition has implications for weak legal protection for women and children in unregistered marriages. This article concludes that legal pluralism needs to be managed through regulatory harmonization and strengthening the role of the state to ensure substantive justice in family law.
