Abstract

Menstrual leave constitutes a form of legal protection for female workers as guaranteed under Article 81(1) of Law Number 13 of 2003 on Manpower; however, in practice, a gap often exists between legal norms and their implementation. This study aims to analyze the implementation of menstrual leave rights at PT Bara Energi Lestari and to evaluate it from the perspectives of labor law and fiqh siyasah dusturiyah. Employing an empirical juridical approach through interviews and normative legal analysis, the findings indicate that the company’s menstrual leave policy aligns with statutory provisions and reflects substantive justice, as demonstrated by a simple application procedure, full wage protection, and the absence of negative consequences on performance evaluation. These findings suggest that protection of women’s biological conditions can coexist with workplace productivity. From the perspective of siyasah dusturiyah, the practice is consistent with the principles of protection of life, removal of hardship, and proportional justice, although its success is strongly influenced by organizational culture and managerial commitment. The academic contribution of this article lies in integrating labor law analysis with fiqh siyasah dusturiyah to position menstrual leave as an instrument of substantive justice in modern employment relations while offering a gender-responsive policy model.
